1. Our Role and Service

FreeWPStuff is a resource platform that promotes free GPL-licensed WordPress themes, plugins, and PHP-related code. Important: We do not host, upload, or store any files on our servers. We only provide information about and links to resources that are publicly available on the internet and hosted by third parties.

2. Filing a DMCA Copyright Infringement Notice

If you believe that content on FreeWPStuff infringes your copyright, you may submit a DMCA takedown notice to our designated Copyright Agent.

2.1 Required Information

Your DMCA notice must include the following information to be valid:

2.3 Important Notes for Copyright Holders

We Do Not Host Files: Since we do not host any WordPress themes, plugins, or other files on our servers, we can only remove links and references to allegedly infringing content hosted elsewhere. Your DMCA notice should identify:

  • Specific pages on FreeWPStuff that link to the allegedly infringing content
  • The URLs of the external sources where the files are actually hosted (if known)

GPL and Open Source Considerations: WordPress themes and plugins are licensed under the GNU General Public License (GPL), which allows free distribution and modification. Please ensure that your copyright claim is valid and that the content in question is not legitimately licensed under GPL or another open source license.

Contact the Actual Host: For faster resolution, you may also want to contact the website that actually hosts the files, as they have direct control over the content.

3. Our Response to Valid DMCA Notices

Upon receiving a valid DMCA notice that complies with the requirements above, we will:

  1. Promptly review the notice to ensure it meets DMCA requirements
  2. Remove or disable access to the allegedly infringing content (links, descriptions, or references)
  3. Notify the affected party (if applicable) that content has been removed due to a copyright complaint
  4. Maintain records of DMCA notices in accordance with legal requirements

4. Counter-Notification Process

If you believe that content removed from FreeWPStuff was removed in error or that you have the right to post the content, you may submit a DMCA counter-notification.

4.1 Required Information for Counter-Notification

Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the removed material: Description of the material that was removed and the location where it appeared before removal
  3. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which FreeWPStuff may be found), and that you will accept service of process from the person who filed the original DMCA notice or their agent
  5. Your contact information: Your name, address, telephone number, and email address

4.3 Our Response to Counter-Notifications

Upon receiving a valid counter-notification:

  1. We will forward a copy to the original complainant
  2. We will inform the complainant that we will restore the removed content in 10-14 business days
  3. We will restore the content unless the copyright owner files a court action seeking an injunction against the allegedly infringing activity

5. Repeat Infringer Policy

FreeWPStuff maintains a policy of terminating, in appropriate circumstances, users or content sources that are repeat copyright infringers. We reserve the right to remove links to external sources that are the subject of repeated valid DMCA notices.

6. Misrepresentation and False Claims

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that:

  • Material or activity is infringing, or
  • Material or activity was removed or disabled by mistake or misidentification

May be subject to liability for damages, including costs and attorneys’ fees.

Do not make false claims. Submitting a DMCA notice or counter-notification requires statements made under penalty of perjury. False or fraudulent claims may result in legal consequences.

7. Limitations of Our Service

7.1 Third-Party Hosting

We remind copyright owners that FreeWPStuff does not host files. When you submit a DMCA notice:

  • We can remove links and information about allegedly infringing content
  • We cannot delete files hosted on third-party websites
  • The files may still be available on the original hosting platforms

For complete removal, you should also file DMCA notices with:

  • The websites that actually host the files
  • Search engines that may index the content
  • Other platforms that link to or distribute the content

7.2 GPL License Considerations

WordPress core software, as well as many themes and plugins, are distributed under the GPL license. The GPL grants certain rights including:

  • The right to use, modify, and distribute the software
  • The right to access source code
  • The freedom to redistribute copies

Before filing a DMCA notice, please verify:

  • That you own the copyright to the work in question
  • That the work is not licensed under GPL or a compatible license
  • That the alleged infringement violates your exclusive rights
  • That “premium” or paid versions of GPL software can still be legally redistributed

9. International Copyright

While the DMCA is a United States law, FreeWPStuff respects copyright laws globally.
